How to handle a work injury
Injured at work?
If you have been injured while you were at work, you may be concerned about the consequences in terms of lost earnings, recuperation costs and your future within the company. Here are some points you should consider following an accident at work.
Legal advice
If you have been injured at work, it is important to contact a personal injury lawyer to gain independent legal advice concerning your injury as soon as possible. This way, you will ensure that any claim you make will be initiated as soon as possible, and that the correct information is recorded regarding your accident, should there be any need to report this at a later date.
Claiming compensation
If you were injured at work and it was not your fault, you may be able to make a personal injury claim. If you are worried about having to pay legal costs if you lose your case, don't be - you should be able to claim on a 'no win no fee' basis, meaning that you only have to pay your solicitor's fees if you win.
Claiming against your employer
You should not be afraid to make a work accident claim against your employer following a work accident. They will have insurance to pay for your compensation if you succeed in a compensation claim against them. Also, all employers have a duty of care towards their staff, meaning that they should do everything they can to prevent accidents. If your employer failed to do that, it is reasonable to expect compensation for your injury.
Keeping your job
When you have been injured at work and need time off to recuperate, your position within the company should still be there when you return. Under most circumstances, as long as you can still do your job effectively, your employers have a legal obligation to keep your position open for your return. Otherwise they may be liable for unfair dismissal.
Returning to work
When making the transition back to work following an injury, consider all your options. If you go back to work before you are ready, you may worsen your injury and even cause lasting damage. If possible, make an appointment to discuss your options with your employer. They may be able to bring you back gradually by starting you off with a reduced workload, flexible hours or a shorter week, for example, until you are fully recovered.
